While most people are taking a rest over the Spring Festival, there are some professions that require non-stop operation, like the telecom service, transportation, media, and others.
Extra work over the holidays is supposed to mean those working get double or triple pay, according to the Labor Laws of China, but the regulation has been distorted in practice and few people actually get the money they deserve.
One opinion from Shanghai Evening Post says a lot of employees, especially new-comers in the job market, choose to accept the fact that they are not recieving their holiday pay. And that is partly because getting a job is not easy.
But the opinion says modern management has introduced changes in enterprises, as more employees get serious with their rights, bosses should be aware that they will pay a price for having this negative image. After all, the core competitiveness of enterprises lies in human resources. Another opinion from Xinhua net calls for employees to be cautious in several ways about employers not got giving the holiday pay. It says the law regulates that employees should be paid no less than three times the average hourly or daily salary if they work on the first three days of the Spring Festival and twice as much over the next four days.
But some companies have their way of calculating hourly or daily salary, which is usually much lower. And some have skipped paying their employees by arranging several days off after the festival, which, the opinion says, is not an option.
One opinion from Beijing News puts the blame on the loopholes in the current law. It says the pay of employees is usually an accumulation of several things, including basic salary, bonuses and welfare, but the labour laws haven¡¯t made clear which part should be doubled or tripled for the holiday pay.
Although some local governments have their explanations, there is yet to be any standard to follow. A complete system to calculate salary is urgently needed.
