• Fight between Beverage Giants Spills out in Public
The dispute between Chinese beverage company Wahaha and its French partner Danone took another unusual and very pubic twist on Friday with the Wahaha president admitting he made mistakes but insisting the original contract he signed isn't valid.
 
 
History of Wahaha-Danone's Joint Ventures

-- Danone entered into five joint ventures with Hangzhou Wahaha Group in 1996 in an agreement, producing purified water, mixed congee and other foodstuff products under the "Wahaha" trademark.

-- Danone obtained the controlling skake of 51 percent share of the joint ventures after the Asian Financial Crisis in 1997. Before long, the two companies reached an agreement barring the Chinese company from making products that competed with those produced by the ventures or using the Wahaha brand without Danone's consent.

-- Danone now accuses Wahaha of trademark infringement in manufacturing and marketing beverage products under the same Wahaha brand outside of the joint ventures, which have the exclusive rights to such trademarks.

 
 
Danone's Actions in China

1. Since entering China in 1987, Danone has acquired stakes in at least seven leading Chinese food and dairy companies, including Shanghai-based Bright Dairy & Food Co., Shenzhen Health Food Co., Guangdong Robust Group and Shanghai Aquarius Drinking Water Corp.

2. In 2000, Danone bought 92 percent of Wahaha's biggest rival, Guangdong Robust Group, which Wahaha says cost it market share and the loss of 49 million yuan in profit that year.

3. In Apirl 2005, Danone bought a 45.2 percent stake in Shanghai-based Bright Dairy and Food Co. and a 22 percent stake in Beijing-based Huiyuan Juice Holdings Co.

4. In December 2006, Danone set up a joint venture with Mengniu Dairy Co., China's largest liquid milk producer, in which it owns a 49-percent stake.
